Terms and Conditions for Listing – Car Listing

Please read these Terms carefully before submitting a vehicle listing. By paying for and publishing a listing, you agree to be bound by these Terms.


1. Definitions

  • “Platform” – The website https://sand.carlisting.online, owned and operated by KIT Experience.
  • “Owner” – KIT Experience (registered business in the Republic of South Africa).
  • “Seller” – Any user (registered motor dealer, private seller, or business) who lists a vehicle for sale.
  • “Listing” – A single advertisement for one specific vehicle (car, truck, motorbike, bus, trailer, etc.) uploaded to the Platform.
  • “Listing Period” – The fixed duration of 32 calendar days during which a paid Listing is visible to buyers.
  • “Pay per Listing” – The pricing model where the Seller pays a one‑time fee (the current Listing Fee, displayed at the time of checkout) per Listing. No recurring subscription.
  • “Listing Fee” – The amount payable to activate a Listing for the full 32‑day Listing Period. The fee is subject to change and is always shown before payment.

2. Eligibility to List

You may list a vehicle on Car Listing if:

  • You are a registered motor dealer in South Africa (with valid Dealer number) or a private individual (18 years or older) selling a vehicle you legally own.
  • You have the right to transfer ownership of the vehicle.
  • You provide accurate, complete, and lawful information about the vehicle.

Prohibited sellers:

  • Anyone previously banned from the Platform for fraud, spam, or illegal activity.
  • Sellers offering stolen, cloned, or encumbered vehicles without disclosing the financial interest (e.g., bank‑financed vehicles).

3. The “Pay per Listing” Model – 32‑Day Validity

3.1 Payment before publication
All Listings are paid in advance via the Platform’s accepted payment gateways (including but not limited to Paystack, PayFast, Yoco, and bank transfer). A Listing will only go live after successful receipt of the full Listing Fee.

3.2 Duration – 32 consecutive days

  • Once paid, your Listing is active for exactly 32 calendar days from the time of activation.
  • After 32 days, the Listing automatically expires and is removed from public search results.
  • You will receive reminder emails on day 28 and day 31 (if you have opted in to notifications).

3.3 No prorated refunds

  • If you delete or manually remove a Listing before the 32 days end, you forfeit the remaining days. Refunds are not provided for early removal.
  • The only exception: If the Platform removes your Listing for a breach of these Terms (see Section 7), no refund is given.

3.4 Re‑listing

  • After a Listing expires, you may pay a new Listing Fee to publish the same vehicle again for another 32‑day period.
  • Re‑listing does not automatically preserve previous views or inquiries.

4. What You May List & Image Limit

You may list any road‑legal vehicle intended for sale in South Africa, including:

  • Passenger cars
  • Motorcycles / scooters
  • Trucks (light, medium, heavy)
  • Buses / minibuses
  • Trailers / caravans
  • Agricultural and construction vehicles (tractors, loaders, etc.)

Image limit:

  • You may upload up to 30 images per Listing.
  • All images must accurately represent the actual vehicle for sale. Misleading or doctored photos are prohibited.

Prohibited listings:

  • Vehicles that are not in a saleable condition (e.g., wrecked parts‑only sales, salvage without clear title) – unless explicitly stated with photos of damage.
  • Vehicles with altered or falsified VIN / engine numbers.
  • Parts or accessories alone (this is a vehicle listing platform, not a parts store).
  • Illegal off‑road vehicles that cannot be registered for public roads in South Africa (unless clearly marked “off‑road use only”).
  • Listings that impersonate a dealer without a valid registration.

5. Seller Obligations

As a Seller, you must:

  • Provide true and recent photos (maximum 30 per Listing) showing the actual vehicle. Stock images are allowed only for brand‑new dealer stock, but must be accompanied by at least one real photo of the physical vehicle.
  • Disclose material defects – mechanical, structural, accident history, flood damage, outstanding finance (bank lien), or code 3 (rebuild) status.
  • Set a realistic price in South African Rand (ZAR). No bidding or auction-style listings are allowed unless explicitly agreed with Car Listing in writing.
  • Respond to buyer inquiries within a reasonable time (recommended: 2 business days). Persistent non‑response may lead to Listing removal.
  • Honour the advertised price – you may not increase the price after a buyer has expressed a bona fide interest, unless the price was a genuine typographical error.

6. Payment Terms

6.1 Listing Fee – The current fee is displayed at the point of listing (excluding VAT if applicable). The fee may be changed from time to time by KIT Experience; the applicable fee is always the one shown before you confirm payment.
6.2 No automatic renewal – Because this is Pay per Listing, your payment does not auto‑renew. You must actively pay again to re‑list after 32 days.
6.3 Taxes – Sellers are responsible for any VAT, income tax, or other tax obligations arising from the sale of their vehicle. Car Listing / KIT Experience is not a tax advisor.
6.4 Chargebacks – If a Seller fraudulently initiates a chargeback after their Listing has been live, KIT Experience reserves the right to permanently ban the Seller and pursue collection of the fee.


7. Prohibited Conduct & Consequences

You may not:

  • Post the same vehicle more than once at the same time (no duplicate Listings).
  • Use the Listing to collect buyer data for off‑platform spam or scams.
  • List a vehicle that you do not own or have legal authority to sell.
  • Include external links (e.g., to other classifieds or sales pages) in the Listing description.
  • Harass or mislead buyers who contact you through the Platform.

Consequences of breach:
KIT Experience (Car Listing) may, without prior notice, remove any Listing, suspend your account, or permanently ban you. No refund will be provided for removed Listings. We may also report fraudulent activity to the South African Police Service (SAPS) or the National Consumer Commission.


8. Platform Role & Disclaimer

Car Listing is an online classifieds platform operated by KIT Experience – we are not a party to any sale transaction between Seller and Buyer.

  • We do not inspect vehicles, verify ownership, or guarantee the accuracy of Seller‑provided information.
  • We do not handle payments between Seller and Buyer, nor do we offer escrow services.
  • No warranty – The Platform is provided “as is”. We do not warrant that any vehicle will be sold within the 32‑day Listing Period.

You agree to indemnify KIT Experience (Car Listing) against any claims, losses, or damages arising from your vehicle sale, including but not limited to disputes over condition, ownership, or financing.

To request a refund under the “Platform error” clause, email billing@sand.carlisting.online within 7 days of the issue occurring.


10. Intellectual Property

By uploading photos and descriptions to your Listing, you grant Car Listing / KIT Experience a non‑exclusive, royalty‑free, worldwide license to display, resize, and promote those images on our website and social media channels (e.g., featuring a “Vehicle of the Day”). You retain ownership of your original content.


11. No App – Storage Consideration

You acknowledge that Car Listing is a website only – there is no mobile application to download.

  • This means you will never be asked to install software on your device.
  • You can save the website as a browser bookmark or home screen shortcut without consuming significant storage space.
  • If you delete your browser history or cookies, your login session may be lost, but your Listing remains active until the 32nd day.

The Platform is fully responsive and works on all devices, including low‑storage smartphones.


12. Amendments to These Terms

We (KIT Experience) may update these Terms from time to time. Material changes will be communicated via a banner on the website or email to registered Sellers. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.


13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa.

Disputes:

  • First attempt informal resolution by contacting support@sand.carlisting.online.
  • If unresolved, either party may refer the dispute to the Motor Industry Ombudsman of South Africa (MIOSA) or the National Consumer Tribunal, as applicable.
  • For monetary claims under ZAR 20,000, the dispute shall be resolved through binding arbitration in terms of the Arbitration Act, No. 42 of 1965, held in Johannesburg or Cape Town (at KIT Experience’s reasonable discretion).
